All sales and deliveries by COMETAL shall be understood subject to the terms and conditions. To avoid mistakes, the customers’ orders must be send by writing (fax, e-mail,) with indication of the references, descriptions and quantities desired, according to the price list in effect at that time.

Given the continuing advances in technical and product enhancements, COMETAL reserves the right to modify its specifications for the information provided in advertising, so as to make few changes in design and materials deemed appropiate,which may affect the price of the products offered.

Published prices are valid except for topographical mistake. Prices, features and availability of products marketed by COMETAL may oscillate therefore be reported to the client before accepting any order.

The price of products is the one in force at the time of acceptance of order by COMETAL. If a customer placing and order with a wrong price, COMETAL provide you with the correct price, to keep the customer interested in the product is applied at the correct price by COMETAL.

All orders are subject to its acceptance by COMETAL.

The prices are “ex works”, excluding VAT. Any other tax which will increases the sale the buyer will take care of it. Packaging is included in the price.

Indications on the delivery time are considered approximate and without obligation to COMETAL, no an essential element of the contract.

COMETAL not be liable for failure to comply with its obligations to deliver when it is due to events which could no be foreseen, or still under are unavoidable, and especially in cases of damage, changes in production, delay, r inability to obtain needed supplies.

COMETAL guarantees all products of our manufacture for one year from the date of actual delivery against defects in manufacture that product or that this is evident within one year for.

This guarantee is exclusively committed to COMETAL to repair the defective product, if in their opinion of this company that repair was possible. Otherwise, the guarantee is a commitment to deliver customer another product of COMETAL to preplace the defective, and therefore with similar characteristics, function and price, in both cases, the guarantee will be effective once the customer delivers to the company of all faulty product within one year.

The guarantee covers the points relating specifically excluding for any expenses which might arise to client delivery or return the product to COMETAL and derivatives work and activities necessary for the replacement, reinstatement or repositioning of the product.

The guarantee does not cover damage or defects in products by blows, defective transport, errors of installation, normal weathering by usage, improper or bad used, well as those caused by not following the manufacturer´s instructions.

Not accept returns without authorization or consent of COMETAL, S. L. in case of allow, shipping costs or returns costs will be borne by the customer. Any return that is not the effectiveness of the guarantee issued by COMETAL, aforementioned, will be loaded with 10% of the purchase price in respect of conditioning of material.

COMETAL S. L reserves the right to ownership of the goods supplied until payment is made the same.

The material is suitable only and exclusively for agricultural use, so that COMETAL not responsible for any loss or damage that may occur to others as a result of the use of such products for any intended use or purpose.

Both parts, buyer and seller are subject to the jurisdiction of the Judges and Courts of Albacete for processing and resolution of lawsuit arising from any operation.

COMETAL may consider and accept if any other condition of sale written, for the validity of which shall be in writing.
